Release and Liability Waiver Form
for all javelin throwers
THIS RELEASE AND LIABILITY WAIVER FORM
IN CONSIDERATION of being allowed to participate in the JavelinStrong.com Javelin program, the receipt of which is hereby acknowledged, I (the "Legal Guardian" of any participant under the age of 18 or "Adult Participant" who is 18 and older) agree on behalf of myself as the Adult Participant or minor participant (further known as the "Participant) with JavelinStrong.com, 9026 Dixie Lane, Needville, TX 77461 and their coaching staff, specifically our Javelin Coach Lisa Bowling who will be heading up our JavelinStrong.com Javelin Program (the "Activity Provider") to the following:
DETAILS OF ACTIVITY AND RISKS
1. Scheduled for the 2026 year running from January 1st to December 31st, the Participant will be participating in the following activity: JavelinStrong.com Javelin Program provided by the Activity Provider. The Participant and their Legal Guardian acknowledges that this Activity includes significant risks involved (such as falls, contact with equipment, or actions of other participants), and voluntarily assumes those risks. Common javelin injuries are related to but not limited to the shoulder, elbow, and back.
CONSIDERATION
2. Being the lawful guardian of the Participant or the adult participant, and in consideration of the Participant being permitted to participate in the JavelinStrong.com Javelin Program, on behalf of the Participant the Legal Guardian or the adult participant releases and forever discharges the Activity Provider, its owners, directors, officers, employees, agents, assigns, legal representatives, and successors from all manner of actions, causes of action, debts, accounts, bonds, contracts, claims, and demands for or by reason of any injury to person or property, including injury resulting in the death of the Participant, which has been or may be sustained as a consequence of the Participant's participation in the Activity, and not withstanding that such damage, loss, or injury may have been caused solely or partly by the negligence of the Activity Provider or by another Participant.
3. The Legal Guardian or the adult participant understands that the Participant would not be permitted to participate in the JavelinStrong.com Javelin Program unless the Legal Guardian or the adult Participant signed this waiver.
CONCURRENT RELEASE
4. The Legal Guardian or the adult Participant acknowledges that this waiver is given with the express intention of effecting the extinguishment of certain obligations owed to the Participant by the Activity Provider, and with the intention of binding the Participant's heirs, executors, administrators, legal representatives, and assigns.
FITNESS TO PARTICIPATE
5. The Legal Guardian or the Adult Participant acknowledges to the Activity Provider that the Participant does not have any physical limitations, medical ailments, or physical or mental disabilities that would limit or prevent the Participant from participating in the Activity. If required, the Participant will obtain a medical examination and clearance.
MEDICAL CONSENT
6. The Legal Guardian or the Adult Participant gives the Activity Provider consent for emergency first aid and/or medical treatment if an injury occurs during the participation of the Activity, with the understanding that the participant is responsible for any and all associated costs.
FULL AND FINAL SETTLEMENT
7. The Legal Guardian or the Adult Participant acknowledges and agrees with the Activity Provider that: (1) the Activity Provider has given the Legal Guardian or the Adult Participant sufficient time to carefully read this Waiver, (2) the Legal Guardian has been given the opportunity and has been encouraged to seek independent legal advice prior to signing this Waiver, (3) the Legal Guardian or the Adult Participant understands the risks and claims that the Participant is waiving to participate in the Activity, (4) the Legal Guardian or the Adult Participant is freely and voluntarily executing the Waiver, and (5) the Participant is forever prevented from suing or otherwise claiming against the Activity Provider for any property loss or personal injury that the Participant my sustain while participating in or preparing for the Activity.
GOVERINING LAW
8. This Waiver will be governed by and construed in accordance with the laws of the State of Texas.
